Mediation Process
- Pre-Mediation Planning: A conference with the parties’ counsel addressing logistics and preliminary matters typically held 2–3 weeks before mediation.
- Mediation Briefs: To ensure efficiency and clarity, mediation briefs should be submitted 7–14 days prior to the scheduled mediation meeting. It is recommended that they be prepared in Word format for seamless navigation and referencing. Supporting documents should be organized with an index, with clear labels and pagination when possible, to enhance accessibility and ease of review.
- Mediation meeting: The mediation session will focus on defining key facts, articulating underlying interests, overcoming barriers to resolution and finding solutions. The process may include both joint discussions and private caucusing to achieve optimal outcomes. Nathalie offers mediation virtually, or in person (fees may apply).
- Reporting: Nathalie prepares a closed-mediation report at the end.
